Times Change, so dies Batman. When Batman and The Joker started, Batman Killed criminals with a gun (Sometimes, he would break necks more often)and The Joker smiled with out meaning it, the premise was you saw his white skin and his permanent smile(wasn't cut like in TDK that was how his face looked like) but his eyes were filled with hate. or something like that.This Batman as much as little fanboys don't like to admit, is an acurrate Batman as to how he was in the 60's.

Maybe they didn't arrest the Joker right off is so they could investigate the case further and get more evidence against him. If they wanted to just arrest him, Gordon and O'Hara wouldn't have been there incognito. They would've come right out and apprehended him.
